Release & Waiver of Liability
In consideration of being permitted to participate in classes, open studio, camps, parties, workshops and other activities (the "Activities") offered by Art Studio LLC, doing business as Supernova Studio ("the Studio"), at 620 Del Ganado, San Rafael, CA 94903 or elsewhere, I agree as follows:
1. Assumption of risk. I understand that art and craft activities involve risks including, without limitation, cuts and punctures from sharp tools; burns from hot glue, irons, heat tools or kilns; slips and falls; allergic or skin reactions to paints, clays, dyes, adhesives, fibers or other materials; eye injury; and damage to clothing or personal property. I knowingly and voluntarily assume all such risks, known and unknown.
2. Release. To the fullest extent permitted by law, I release, waive and discharge the Studio and its owners, members, managers, employees, instructors, guest teachers, volunteers and agents from any and all claims, demands, losses and liability for injury, illness, death, or property loss or damage arising from or related to participation in the Activities or the creation of art or crafts, including claims arising from the ordinary negligence of the Studio.
3. Unaccompanied minors. If I am the parent or guardian of a minor participant and I choose to leave the minor at the Studio without an accompanying adult (including drop-off classes, camps, open studio and parties), I do so at my own risk. I release the Studio from any liability arising from the minor being present without a parent, guardian or other accompanying adult, including during arrival, departure, breaks, and any time before drop-off or after the scheduled pick-up time.
4. Indemnity. I agree to indemnify and hold harmless the Studio from any claim brought by or on behalf of the participant, including any claim brought by a minor participant, arising from the Activities.
5. Medical care. I authorize the Studio to obtain emergency medical treatment for the participant if I cannot be reached, and I accept responsibility for its cost. I confirm the participant has no condition that would make participation unsafe, or that I have told the Studio in writing.
6. Conduct and photos. The participant will follow instructor directions and studio rules. The Studio may remove anyone whose conduct is unsafe.
7. General. This agreement is governed by California law. If any part is found unenforceable, the rest remains in effect. This waiver applies to all current and future visits until revoked in writing. I have read this agreement, I understand I am giving up substantial legal rights, and I sign it voluntarily.
